GENERAL CONTRACTING CONDITIONS
1st.- Legal Framework
In compliance with current regulations, the entity HOTEL VALLE DEL ESTE SLU, which operates through the internet from this website VALLEDELESTE.ES, details below the general terms and conditions of contracting for the products and/or services offered through it and from which the rights and obligations of the parties are generated.
2nd.- Identification
The purpose of these General Terms and Conditions of Contract (hereinafter "Terms and Conditions") is to regulate the relationship between HOTEL VALLE DEL ESTE SLU (hereinafter the "Provider") and the clients (hereinafter the "User"), relating to all transactions carried out through the online store website.

2º.2.- The User
A user or client shall be understood to be an Internet user who acquires this status by registering on the website, using a form and who is assigned a username and password, for which they have full responsibility for use and custody, being responsible for the veracity of the personal data provided to the provider, as we will see in the User Registration section.
3rd.- Acceptance
By accepting these Conditions, the User declares:
1. That he is a person with the capacity to enter into contracts according to current regulations.
2. That you have read and accept these Conditions.
4th.- Availability
The User will always and in all cases have access to the conditions prior to the start of the product contracting process, and they may be stored and/or reproduced on a durable medium.
5th.- Validity or Duration
The validity period or duration of these Terms and Conditions of Contract will be the time they remain published on the aforementioned website and will apply from the moment the User uses the website and/or proceeds to purchase any products.
6th.- Modifications
The provider reserves the right to unilaterally modify these Conditions, without affecting the goods or promotions that were purchased prior to the modification by the User.
The User agrees to carefully read the terms and conditions each time they purchase a product, as they may have been modified since the last time they accessed the product.
7th.- Nullity
If any clause included in these Conditions is declared totally or partially null or ineffective, such nullity will affect only that provision or the part thereof that is null or ineffective, with the remainder of the Conditions remaining in force.
8th.- Purpose of the contract
The purpose of this contract is to regulate the contractual relationship between the provider and the user at the time the user accepts the purchase during the online contracting process, using the mechanisms described below.
The contractual relationship of sale entails the delivery, in exchange for a price determined and publicly displayed on the website, of one or more specific products.
Each of these products may be subject to specific regulations through the specific contracting conditions for each product. Further details will be provided in the warranty, returns, and withdrawal sections, or in the product's technical sheet, due to the different formats in which the products are sold, their packaging, or their very nature.
9th.- User Registration
The user may register on the website to subscribe to the Newsletter by clicking on the "SUBSCRIBE TO NEWSLETTER" button in the center. To do so, they must enter the mandatory personal information: first and last name and email address. Registering as a website user will provide access to the website, the purchase of products, and the receipt of newsletters containing information about the company and its products.
For user registration for golf tournament entries, the requested information is: first name, last name, golf license number, contact email address, and phone number.
The user will select a username and password, and agrees to use them diligently and not make them available to third parties. They also agree to notify the provider of any loss or theft of such data, or of possible unauthorized access by a third party, so that the provider can immediately block them. The user is fully responsible for their use and safekeeping, and is responsible for the accuracy of any personal data provided to the provider.
The user may not choose as a username words that are intended to confuse others by identifying him/her as a member of the provider, as well as expressions that are foul, insulting, and in general, contrary to the law or the requirements of morality and good customs.
10th.- Geographical scope
This website, www.valledeleste.es, operates and sells domestically and internationally. This geographical area is hereinafter referred to as "the Territory." Therefore, services are only offered within the Territory. Use of this website, as well as any purchases made thereon, are considered to have taken place in Spain and are therefore subject to current Spanish laws and regulations.
All of the above is without prejudice to the possibility that we may soon offer these services in the excluded areas, in which case we will announce this in advance on this website.
11º.- Product Information
The Provider pays great attention to providing information regarding the characteristics of the services offered through technical descriptions and photographs. All this is done within the limits of technology and in compliance with market standards.
12º.- Taxes, currency and shipping costs
In accordance with current regulations, all purchases made through the website are subject to Value Added Tax (VAT).
Prices include Value Added Tax (VAT) and will always be expressed in Euros (€). Unless expressly stated otherwise, these prices do not include shipping costs or any other additional services or additions to the purchased product.
13th.- Language in which the contract is developed
The booking and reservation process for both the hotel and golf tournament registrations will be in Spanish and English, and therefore, these will be the languages used for bookings.
14-Steps of the Contracting / Purchasing Process
14º.1.- Registration
The User may register on the website to subscribe to the Newsletter by clicking on the "SUBSCRIBE TO NEWSLETTER" button in the center. To do so, they must enter the mandatory personal information: first and last name and email address. Registering as a User of the website will provide access to the website, the purchase of products, and the receipt of newsletters containing information about the company and its products.
The registration system does not include a user verification system during the registration process. Therefore, before activating the user in the system, a welcome message is sent to the user's email address. Once successfully registered, the user can log in with their username and password to their profile control panel to manage all the features made available by the website provider, such as the account details section, My Orders, and the ability to exercise their rights.
Once you have registered, you can proceed to purchase your product(s).
14º.2.- Purchase process
Bookassist/Automatic Netware Limited (hereinafter referred to as “Bookassist”) collaborates with the Provider in providing this Booking Process.
By accepting the Bookassist-specific Terms and Conditions and completing the Booking Process, Bookassist agrees to provide you with the necessary tools to complete the booking, as described and linked in this Booking Process, with the Accommodation Provider.
The booking process is easy and straightforward.
1‐ Select dates and number of people. The system will display a list of available accommodations, available golf courses, and the prices charged by the properties on the selected dates.
2‐ The total price of the reservation is displayed, along with the deposit to be charged to the credit card, if requested. Personal information, a contact phone number, approximate arrival time, and any special requests are requested. The reservation is confirmed and the terms and conditions are accepted.
3‐ This is the secure page where you enter your credit card information. You'll need to enter your card number, card type, expiration date, and the last three digits of the security code, located on the back of the magnetic strip.
4. The final page displays the confirmation with the reservation code. This page is also sent by email to the indicated address. This email again contains all the details regarding your reservation and contact information.
Regarding the return and refund of GOLF course reservations, the reservation process is described below:
1) Player search by name and/or license number.
2) Email – Phone – Comments
3) Data confirmation
4) Accept the Legal Notice, Valle del Este Privacy Policy, the Valle del Este Terms of Service, the Golfdirecto Legal Notice and Privacy Policy, and End.
Provisions to take into account in the purchasing process.
15th.- Product availability
The reservation offered is subject to availability. If availability is not reached, the user will not be able to make the desired reservation for the indicated dates.
16th.- Types of products
The website's main activity is hotel room bookings. You can add green fees, buggies, spa treatments, dining experiences at Maraú Beach Club, in-room food and drink packages, a pet supplement, or cycling packages to your room reservation. These services are all associated with your room reservation; these services cannot be purchased without prior reservation.
On the other hand, and regardless of the qualification reservation, it is possible to reserve and register for our golf tournaments.
17th.- Maximum order amount
There is a maximum of five rooms per reservation. There is no limit to golf tournament registrations.
18º.- How to extend or cancel my order
To extend a reservation, you can always do so as long as you haven't completed the purchase process by clicking the "Continue Shopping" button.
GENERAL RATE - FLEXIBLE
Payment for your reservation: You will be charged the first night's stay if you cancel within two days of your arrival date.
The property reserves the right to cancel the reservation in the event of an invalid card. In the event of a no-show, a fee will be charged according to the rate's cancellation policy.
Regarding additional services and accommodation packages, these additional services are non-refundable under any circumstances if you enjoy your reservation (accommodation). Cancellation Policy: You may cancel or modify your reservation free of charge up to 48 hours before your arrival date. After this period, one night's stay will be charged, and this amount will not be refunded. In the event of a no-show, 100% of the first night's stay will be charged.
PREPAID AND NON-REFUNDABLE RATE.
The hotel will charge your credit card for the full amount of your reservation. If your card does not have sufficient credit or is invalid, the hotel reserves the right to cancel your reservation.
IMPORTANT: When booking with this rate, your reservation cannot be canceled for any reason. You can only change the date once, maintaining the same or higher price, with the same booking conditions and room type. Changes are made based on rate restrictions, prices, and real-time availability. Changes are permitted up to 14 days prior to arrival. If you do not show up at the hotel on your arrival date, the fee will NOT be refunded. Prices valid for individual reservations only; not applicable to groups and/or special events.
SEMI-FLEXIBLE RATE
Payment for the reservation: Guests must prepay the full amount of the reservation within 14 days of arrival. The property reserves the right to cancel the reservation in the event of an invalid card.
Regarding additional services and accommodation packages, these additional services will not be refundable under any circumstances if you enjoy your reservation.
Cancellation Policy: You can cancel or modify your reservation free of charge up to 14 days before your arrival date. After this period, the full amount of your stay will be charged and non-refundable. In the event of a no-show, 100% of the total reservation price will be charged.
Regarding registrations for golf tournaments organized by Valle del Este, no refunds or reimbursements will be issued except for reasons of force majeure, and official proof of registration is required.
19th.- Invoice
Where can I check my invoice? The invoice will be sent to the guest by email. If not previously requested, it will be given to the reception desk on the day of departure for hotel reservations.
To receive a registration invoice for Valle del Este golf tournaments, you must request it from our pro shop on the day of the tournament or by email to belen@valledeleste.es.
20th.- Value added tax
In accordance with current regulations, all purchases made through the website are subject to Value Added Tax (VAT).
21º.- Payment methods or modalities
The payment method for both hotel reservations and golf tournament registrations will be:
A) By credit/debit card, for which you will provide, among others:
(i) name and surname;
(ii) card number;
(iii) CVV/CVC;
(iv) card expiration date;
Once you've validated all the information about your reservation, a choice will appear to select which payment method you wish to use and enter your details.
If the payment platform reports a denial of the card, the order will be automatically canceled. The customer will be notified online and immediately of the cancellation, as previously mentioned. Payments cannot be made with cards issued outside of Spain.
Your card details are protected at all times thanks to the banks' secure servers, which use SSL encryption for their communications. Your card details will not be stored in our database; when you fill them in, they will be stored on the bank's secure website.
22º.- General provisions on the Payment Process
- The payment order given by the User necessarily implies acceptance of these General Conditions as well as the specific conditions of the order. - For any payment method chosen by the User, all payments will be subject to the terms and conditions applicable to the User by the financial institutions involved or by secure payment platforms (e.g., Visa, Mastercard, etc.).
- Once payment has been successfully made, the User will receive an informative and confirmation email confirming the essential conditions of the transaction:
o Contracted services, and description of the provision thereof.
o Products sent to the address indicated by the User.
The confirmation email will contain proof of reservation, which the User may use to request a guarantee from the corresponding merchant upon receiving the order. The Provider reserves the right to cancel payments if there is evidence of fraudulent transactions, and will report any conduct that may be subject to investigation for fraud prevention purposes to the competent authorities.
23º.- Returns of defective, damaged or incorrect products or exercising the right of withdrawal
According to the regulatory regulations, the right to withdraw from the service contracted with VALLE DEL ESTE HOTEL GOLF SPA, SLU is reflected in section 18.
24º.- Exceptions to the right of withdrawal
The right of withdrawal does not apply to the delivery of: Products whose nature may be altered.

26º.- Product warranty
The guarantee for this product corresponds to the effective provision of the access service and enjoyment of the stay in the selected apartment, for the number of people selected and under the conditions of use specified in the confirmation email received after booking.
27th.- Rights of the Provider
● Maintain, modify or suspend its website without prior notice.
● Modify the price of the offers.
● Reject orders due to lack of stock or non-payment by the customer.
● Refuse access to IT tools to clients in the event of non-compliance with these conditions.
● Receive the amount of the customer's purchases, once the transaction is accepted.
● Retain ownership and full ownership of the item until full payment is received from the customer.
● Do not reproduce, transfer or dispose of the information published by the Provider in all its contents without the express permission of the company itself.
● Proceed to correct or amend human or computer errors.
28th.- Limitation of liability
All information provided by the User to the Provider and through the corresponding forms must be truthful. It is the User's responsibility to keep the information provided to the Provider up-to-date. In any case, the Provider is exempt from any liability for damages or losses resulting from providing false, insufficient, inaccurate, or incorrect information.
Access to the website does not imply any obligation on the part of the Provider to verify the authenticity, suitability, completeness, accuracy, adequacy, or updating of the information provided by the User through the corresponding forms.
The Provider shall not be liable in cases where it is the responsibility of the parents, guardians, or legal representatives of minor or incapacitated Users to authorize access, provision of personal information, or use of the website or the contracting of any products or services provided through the applications or web platform. It shall be the responsibility of the aforementioned parents, guardians, or legal representatives to supervise the minor or incapacitated person's access to and use of the contracting of products and services provided through VALLEDELESTE.ES.
User access to the Content does not imply any obligation on the Provider's part to monitor for the absence of viruses or other harmful elements that could have a harmful effect on the User's computer equipment. In any case, the User shall be responsible for the necessary tools to detect such viruses or harmful elements. Consequently, the Provider shall not be liable for any damage caused to the computer equipment of Users or third parties during access to the Content.
The Provider will not be liable for any interruptions in electrical or telecommunications services that prevent users from using the services offered.
29th.- Applicable Law and Jurisdiction
These terms and conditions shall be governed by or construed in accordance with Spanish law in all matters not expressly provided for herein. The provider and the user agree to submit any dispute that may arise from the provision of the products or services covered by these terms and conditions to the Courts and Tribunals of the user's domicile.
If the user resides outside of Spain, the provider and the user expressly waive any other jurisdiction and submit to the Courts and Tribunals of the domicile of THE OWNER OF THE WEBSITE.
30th.- Online dispute resolution platform for consumers and merchants
